Lagos DPP Drops Charges Against Community Chief Owonla

Lagos, Nigeria – In a surprising turn of events, the Lagos State Director of Public Prosecutions (DPP), Dr. Babajide Martins, instructed the dismissal of charges against Chief Moruf Owonla, a prominent community leader in the Ipaja area. Chief Owonla’s case highlights the complexities of land ownership disputes in Nigeria and the role of the DPP’s office in ensuring justice.

From Complainant to Accused: A Twist in the Land Dispute

The case began with Chief Owonla filing a complaint against Alhaji Hassan Alli, accusing him of land grabbing. However, the situation took a dramatic turn when the police charged Chief Owonla himself with criminal trespass, impersonation, and conduct likely to cause a breach of trust.

Chief Owonla, maintaining his innocence, appealed to the DPP’s office for a review of the case. Upon receiving new evidence from him, the DPP’s office launched a thorough investigation. This investigation revealed crucial details that significantly altered the course of the case.

Documents provided by the Lagos High Court and the Lagos State Surveyor-General’s office proved to be game changers. A 2008 judgment showed that ownership of the disputed land belonged to Chief Ekundayo, who happens to be Chief Owonla’s vendor. Furthermore, evidence confirmed that the judgment was successfully executed in the same year.

Dr. Martins explained the decision to dismiss the charges, stating, “In the interest of justice, we meticulously examined the case with the fresh evidence presented by Chief Owonla. It became clear that Alhaji Alli’s occupation of the land constituted an unlawful act based on the judgment and its execution.”

Accusations of Bias Surface

Alhaji Alli, clearly unhappy with the dismissal of charges, accused the DPP’s office and the Attorney-General, Mr. Lawal Pedro, SAN, of bias. He alleged that Mr. Pedro’s prior attorney-client relationship with Chief Owonla influenced the decision.

Dr. Martins vehemently denied these accusations. He emphasized the routine nature of case reviews undertaken by his office and their commitment to taking corrective actions when necessary. “This decision stemmed solely from a meticulous review of the facts presented in the case,” he asserted.

In an attempt to foster peace and avoid further litigation, the DPP’s office initiated their Restorative Justice program, aiming to facilitate dialogue between Chief Owonla and Alhaji Alli. While initial discussions proved promising, Alhaji Alli ultimately opted out, choosing to pursue the case in court.

Maintaining Transparency and Upholding Justice

Dr. Martins concluded by reiterating his office’s commitment to fair play. “The Attorney-General played no role in my legal advice. This was a choice made by my office solely to uphold justice,” he declared.
